Acceptance of Terms

Welcome to Smart Diehl Academy. By accessing our website, enrolling in our programs, or using our educational services, you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you (the parent/guardian or adult student) and Smart Diehl Academy.

If you do not agree with any part of these Terms, please do not use our services or website.

Important: Parents or legal guardians must accept these Terms on behalf of students under 18 years of age.

Services Description

Smart Diehl Academy provides educational services including, but not limited to:

  • One-on-one and small group tutoring (Pre-K through 12th grade)
  • Homeschool programs and curriculum support
  • Enrichment activities and creative learning programs
  • Summer camp and seasonal programs
  • Subject-specific courses and workshops
  • Academic assessment and progress monitoring

Service Availability

We reserve the right to modify, suspend, or discontinue any service at any time without prior notice. We make no guarantees about the continuous availability of our services.

Personalized Instruction

While we strive to provide personalized instruction tailored to each student's needs, actual services may vary based on availability, enrollment, and individual circumstances.

User Responsibilities

As a user of our services, you agree to:

  • Provide accurate and complete information during enrollment
  • Maintain the confidentiality of your account credentials
  • Ensure students arrive on time for scheduled sessions
  • Notify us promptly of any changes to contact or emergency information
  • Respect our staff, instructors, and other students
  • Follow all facility rules and safety guidelines
  • Supervise children during drop-off and pick-up
  • Communicate student needs, challenges, and progress concerns

Prohibited Conduct: You may not use our services for any unlawful purpose, harass staff or students, disrupt classes, or engage in any behavior that violates our community standards.

Payment Terms

Tuition and Fees

Tuition rates vary by program and are subject to change with 30 days' notice. Current pricing is available on our website or by contacting our office.

  • Registration fees are non-refundable
  • Tuition is due according to the payment schedule provided at enrollment
  • Late payments may incur additional fees
  • Payment plans may be available upon request

Payment Methods

We accept payment via credit card, debit card, bank transfer, check, or cash. All payments must be made in advance unless otherwise agreed upon in writing.

Late Payment

If payment is not received by the due date, we reserve the right to suspend services until the account is current. Accounts more than 30 days past due may result in termination of enrollment.

Returned Payments

A fee may be charged for any returned checks or failed payment transactions.

Cancellation & Refund Policy

Session Cancellations

We understand that schedules change. Please adhere to the following:

  • 24-hour notice: Full credit or rescheduling available
  • Less than 24 hours: Session fee applies, no refund
  • No-show: Full session fee applies
  • Emergency exceptions: Considered on a case-by-case basis

Program Withdrawals

If you need to withdraw from a program:

  • Before start date: Full refund minus registration fee
  • Within first week: Prorated refund available
  • After first week: No refund, but credit may be applied to future programs
  • Notice required: Written notice must be submitted

Academy-Initiated Cancellations

If Smart Diehl Academy cancels a session or program due to low enrollment, instructor illness, or unforeseen circumstances, you will receive full credit or refund for affected sessions.

Liability & Disclaimers

Educational Outcomes

While we are committed to providing high-quality educational services, we cannot guarantee specific academic outcomes, test scores, or grade improvements. Student success depends on many factors including student effort, parental support, and individual learning differences.

Limitation of Liability

To the maximum extent permitted by law, Smart Diehl Academy shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of data, profits, or business opportunities
  • Personal injury occurring on our premises (covered by insurance)
  • Damage to personal property
  • Service interruptions or schedule changes

Medical & Health Disclaimer

We are not medical professionals and do not diagnose or treat learning disabilities, ADHD, or other medical conditions. We recommend consulting with appropriate healthcare providers for medical concerns.

Assumption of Risk

By enrolling in our programs, you acknowledge and accept any inherent risks associated with educational activities, including but not limited to physical activities during enrichment programs.

Total Liability Cap: Our total liability for any claims arising from these Terms or our services shall not exceed the amount you paid for services in the 12 months preceding the claim.

Intellectual Property

All content on our website and in our programs, including text, graphics, logos, curriculum materials, and software, is the property of Smart Diehl Academy and protected by copyright laws.

Permitted Use

You may use our materials solely for personal, non-commercial educational purposes. You may not reproduce, distribute, modify, or create derivative works without written permission.

Student Work

We may display student work (with parental permission) for educational or promotional purposes. Parents retain copyright to their child's original creative works.

Privacy & Confidentiality

We are committed to protecting your privacy and maintaining the confidentiality of student information. Please review our Privacy Policy for detailed information about how we collect, use, and protect your data.

Student records are kept confidential in accordance with applicable education privacy laws, including FERPA (Family Educational Rights and Privacy Act).

Governing Law & Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions.

Dispute Resolution

In the event of any dispute, we encourage you to contact us first to seek an informal resolution. If we cannot resolve the matter informally, disputes shall be resolved through binding arbitration in Mecklenburg County, North Carolina.

Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive the right to participate in class action lawsuits or class-wide arbitration.
